The websites located at joinsharey.com and shareymenus.com, and the mobile applications available through the Apple App Store (collectively, the "Site"), together with the services, features, content, and applications offered by Sharey, Inc. ("Company," "us," "our," and "we") (collectively, the "Services"), provide a menu discovery and marketplace platform that allows users to view restaurant menus, contribute authentic visual content, and earn promotional rewards for eligible actions.

This Privacy Policy (this "Policy") explains how we collect, use, disclose, and protect information relating to users of the Services and describes your privacy rights. This Policy is incorporated into and made part of our Terms of Service. By accessing or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, do not access or use the Services.


1. Information We Collect

We collect information in the following ways.

1.1 Information You Provide Directly.

When you create an account or use the Services, you may provide information such as your email address, username, password, and optional profile information. If you create an account using Sign in with Google or Sign in with Apple, we receive basic profile information from those services as permitted by your settings with those providers.

If you submit content through the Services, you provide photos, labels, descriptions, and related metadata. If you contact us for support or other inquiries, you may provide communications and related information.

Promotional reward redemptions are fulfilled through a third-party rewards provider, currently Tremendous. That provider may request additional information directly from you to complete redemption, identity verification, or tax reporting. Company does not issue tax forms directly; tax reporting and form issuance are handled by the rewards provider, unless Company is legally required to do otherwise.

1.2 Information Collected Automatically.

When you use the Services, we automatically collect certain technical and usage information, including device type, operating system, app version, and basic interaction data such as features used and time spent on the Services.

When you submit content, the Services require use of the device camera and capture images directly within the app. Uploading images from the device photo library is not supported. We collect limited metadata associated with submissions, such as capture time, approximate location at the time of capture, device make and model, and other verification signals to help prevent fraud and maintain menu accuracy.

1.3 Location Information.

With your permission, we collect location information while the app is in use. Location information is used to show nearby restaurants and to verify that content submissions are made from a restaurant location in order to help prevent fraud and maintain menu accuracy. Location access is not required to browse menus or use most features of the Services. However, certain features, including eligibility for promotional points, featuring, or verification of submissions, may not be available if location access is disabled.

1.4 Information from Third Parties.

We may receive information from third parties such as authentication services (such as Google and Apple for sign-in), rewards fulfillment providers, and, where applicable, analytics providers. Restaurants may provide menu information directly using our tools, including automated menu ingestion systems.

1.5 Instagram Verification.

Some restaurants may offer an optional multiplier for posting to Instagram Stories. If you choose to participate, we may verify your participation by viewing publicly available Instagram Stories to confirm that you have posted the required content with the correct restaurant tag. We do not connect to Instagram via OAuth or access private accounts. Verification is performed only by checking publicly available stories associated with the handle you provide.

1.6 Cookies and Similar Technologies.

We and our service providers may use cookies, pixels, and similar technologies to remember preferences, ensure functionality, and measure basic usage. We do not currently use cookies for cross-site behavioral advertising. You may be able to control cookies through your browser settings, but disabling cookies may affect the functionality of the Services.

2. How We Use Information

We use information for the following purposes.

2.1 Providing and Operating the Services.

To create and manage accounts, display menus, process content submissions, verify authenticity, award promotional points, enable reward redemption, communicate with you about your account or submissions, and provide customer support.

2.2 Fraud Prevention and Platform Integrity.

To verify that submissions are authentic and made from the claimed location, detect abuse, enforce program rules, prevent fraud, and maintain the quality and accuracy of menus and content on the Services.

2.3 Product Improvement.

To improve features, develop new products and services, and understand how the Services are used.

2.4 Automated Processing and AI Systems.

To organize, structure, normalize, and update menu information; detect errors or duplicates; and improve accuracy using automated and AI-assisted systems. User Content may be used for machine learning, artificial intelligence model training and improvement, and the development of new features or services, as described in the Terms of Service. These processes are used to support platform functionality and do not produce legal or similarly significant effects on users.

2.5 Communications.

To send service-related communications, updates, and security notices. You cannot opt out of essential service communications related to your account or transactions.

2.6 Legal and Compliance.

To comply with applicable laws and regulations, respond to lawful requests from government authorities, resolve disputes, enforce our Terms of Service, and protect the rights, property, and safety of Company, our users, and others.

3. How We Share Information

3.1 Service Providers.

We share information with vendors that help operate the Services, such as cloud hosting providers, customer support platforms, and security providers. These providers may access information only as needed to perform services on our behalf and are contractually obligated to protect your information.

3.2 Rewards Fulfillment Providers.

Reward redemptions are fulfilled through third-party providers, currently Tremendous. When you redeem points, certain information (such as your email address and redemption amount) is shared with the provider to deliver the reward and comply with their legal obligations, including identity verification and tax reporting requirements. Use of rewards is subject to the provider's terms and privacy practices.

3.3 Restaurant Partners.

Restaurants may receive User Content relating to their business, including photos and labels submitted by users. Restaurants may also receive aggregated, non-identifying analytics about their menu pages. Company does not share user contact information with restaurants by default.

In the future, users may be offered the option to explicitly opt in to share limited contact information, such as an email address, with a restaurant for specific purposes such as loyalty programs. Any such sharing will be optional, clearly disclosed at the time of consent, and revocable.

3.4 Content Sublicensing.

As described in the Terms of Service, you grant Company the right to sublicense User Content to restaurant partners and service providers for use in connection with menu display, menu accuracy, and related marketing, including use on the restaurant's owned channels and Company surfaces.

3.5 Legal Disclosures and Business Transfers.

We may disclose information if required by law, in response to valid legal process, to protect the rights, property, or safety of Company, our users, or others, or in connection with a merger, acquisition, bankruptcy, or sale of all or a portion of our assets. In such event, your information may be transferred as part of that transaction.

3.6 Aggregated and De-identified Information.

We may use and share aggregated or de-identified information that cannot reasonably be used to identify you for analytics, research, and business purposes without restriction.

3.7 No Sale of Personal Information.

COMPANY DOES NOT SELL YOUR PERSONAL INFORMATION AS DEFINED UNDER APPLICABLE STATE PRIVACY LAWS.

4. Promotional Points and Incentives

Company offers promotional points ("Points") as an incentive for completing certain actions, such as submitting eligible content, referrals, or other activities offered from time to time. Points are promotional rewards, have no cash value, are not property, and are subject to program rules as described in the Terms of Service.

Points may be adjusted, revoked, or expire as described in the Terms of Service. Rewards are fulfilled through third-party providers, and Company does not hold funds or operate as a bank, money transmitter, or money services business.

To comply with legal requirements and third-party provider requirements, we may require you to provide additional information for identity verification or tax reporting as a condition of redemption. Tax reporting and form issuance are handled by the rewards provider, unless Company is legally required to do otherwise.

5. Your Privacy Rights

5.1 General Rights.

Depending on your location, you may have rights under applicable privacy laws to: a. access the personal information we hold about you; b. correct inaccurate personal information; c. delete your personal information; d. receive a copy of your personal information in a portable format; e. opt out of certain data uses; and f. not be discriminated against for exercising your privacy rights.

5.2 Exercising Your Rights.

You may submit privacy requests by emailing privacy@joinsharey.com or through in-app settings where available. We may verify your identity before responding to your request to protect your privacy and security. We will respond within the time required by applicable law.

5.3 California Residents.

California residents may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, use, and disclose; the right to delete personal information; the right to correct inaccurate personal information; and the right to opt out of the sale or sharing of personal information.

5.4 Other U.S. State Residents.

Residents of other U.S. states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, and Utah) may have similar rights under their respective state laws. We will honor valid requests in accordance with applicable law.

5.5 Do Not Track.

Some browsers have a "Do Not Track" feature. We do not currently respond to Do Not Track signals.

6. Data Security and Retention

6.1 Security Measures.

We use reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, alteration, or destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

6.2 Data Retention.

We retain personal information for as long as necessary to operate the Services, comply with legal obligations, and prevent fraud. Content licenses granted under the Terms of Service may survive account deletion, and certain User Content may remain on the Services after account deletion as permitted under the Terms of Service.

6.3 Account Deletion.

You may request deletion of your account by following the instructions in the Services or by contacting us at privacy@joinsharey.com. Upon account deletion, we will delete or anonymize your personal information in accordance with applicable law, except where retention is necessary for legal or fraud prevention reasons.

7. Children's Privacy

The Services are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. Users must be at least 18 years old to earn promotional rewards. If we become aware that we have collected personal information from a child under 13, we will take steps to delete such information as soon as practicable.

If you are a parent or guardian and believe that your child under 13 has provided us with personal information, please contact us at privacy@joinsharey.com so that we can take appropriate action.

8. International Users

The Services are intended for users located in the United States. If you access the Services from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. The data protection and privacy laws of the United States may differ from those in your jurisdiction. By using the Services, you consent to the transfer of your information to the United States.

9. Third-Party Links and Services

The Services may contain links to third-party websites, services, or applications that are not operated by us. This Policy does not apply to any third-party sites or services. We are not responsible for the privacy practices of any third parties. We encourage you to review the privacy policies of any third-party sites or services before providing any personal information.

10. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will notify you by posting an updated version on the Site or within the Services. The "Last Revised" date at the top of this Policy indicates when this Policy was last updated. Your continued use of the Services after any changes to this Policy constitutes your acceptance of the updated Policy.
